Summary
Mr. Campbell is a member of the firm’s Intellectual Property Litigation Team and serves as first chair trial counsel in many of the firm’s litigation cases. Mr. Campbell has tried more than 30 civil cases throughout the country for many foreign and domestic clients, many to a jury. Mr. Campbell is also well versed in appellate practice primarily before the U.S. Court of Appeals for the Federal Circuit—the exclusive appellate court for patent infringement disputes. Although Mr. Campbell’s practice now primarily focuses on litigation, client counseling and serving as an expert witness, in the past he drafted and prosecuted many patent applications in the mechanical and electrical engineering fields.

Mr. Campbell’s experience in patent litigation began in 1988 with an action in which the firm represented a patentee in a case involving liquid crystal computer displays. In that case, the jury found that the defendant willfully infringed the patent and, before trebling, awarded the patentee $5 million. More recently, Mr. Campbell represented a patentee as first chair trial counsel in a case involving thermal transfer labels. In that case, the District Court found in February of 2004 that the patentee’s patents were valid and were infringed both by the defendant’s original product as well as a product that the defendant specifically designed in an attempt to avoid the patents.

Over 2002 through 2003, Mr. Campbell successfully tried cases for manufacturers of low lethality projectiles and radiation therapy equipment resulting in judgments, which were affirmed on appeal, that the manufacturers’ products did not infringe. In 2005, Mr. Campbell was named an Ohio Super Lawyer in the area of Intellectual Property Litigation by Law & Politics.

Recent precedential cases that Mr. Campbell successfully argued to the Court of Appeals for the Federal Circuit include Combined Systems, Inc. v. Defense Technology Corp. of America, 350 F.3d 1207 (Fed. Cir. 2003); and NOMOS Corporation v. BrainLAB USA, Inc., 357 F.3d 1364 (Fed. Cir. 2004).

Mr. Campbell has also successfully tried many other cases, including cases involving molten metal pumps, neural networks, traffic barrels and many cases regarding computer automated Pap smear screening machines both representing patentees and accused infringers. Mr. Campbell has also successfully handled trademark, false advertising, first amendment, trade secret and copyright cases and negotiated favorable settlements in many more.
