Summary
Tom Fistek represents and counsels clients of all sizes with the preparation and prosecution of U.S. and foreign patent applications. A large portion of Tom's practice is focused on the drafting and prosecuting of patent applications in the mechanical and electrical arts, ranging from telecommunications equipment to innovative building materials and techniques. Tom also has experience in the preparation and prosecution of trademark applications.

Tom assists clients with their patent infringement and validity concerns, and has significant experience in complex litigation matters as part of the firm's Trial Practice Group. Tom is familiar with all levels of litigation including: pre-trial, trial and appellate strategies and procedures. Tom's litigation experience includes cases involving utility and design patent infringement and validity, trademark infringement and unfair competition litigation and the negotiation of settlement agreements. Tom also does significant work in the preparation of patent infringement, validity, and right-to-market opinions.

Tom graduated magna cum laude from the Cleveland-Marshall College of Law, where he served as an Executive Editor of the Cleveland-Marshall Law Review and staff member for The Gavel. While at Cleveland-Marshall, Tom was the recipient of the Spangenberg Trial Practice Award as well as awards for excellence in Patent Law, Intellectual Property, Taxation and Contracts

Tom joined the firm as a law clerk in 2001 and remained with the firm as an associate in 2004. Tom is registered to practice before the U.S. Patent and Trademark Office. He received his Bachelor's of Science in Mechanical Engineering from the University of Maryland at College Park. Prior to attending Cleveland-Marshall, he worked as a Quality Engineer for the Ford Motor Company at the Lorain Assembly Plant.
